What is Emotional Distress?

When you suffer a negative emotional reaction because of an experience, and the effects persist, you may be affected by emotional distress. It is an intense psychological reaction to the injury or event. Symptoms of this may include elevated anxiety, fear, heightened pain, anger, loss of sleep, depression, stress, and more. Physical signs of emotional distress can include ulcers, headaches, and more. In severe cases, Post-Traumatic Stress Disorder (PTSD) may occur. The intensity and duration of the period of emotional distress can vary person to person; and is based on their ability to mentally comprehend and accept what happened.

Build Your Case

If you are suffering from emotional distress due to an injury; see a doctor or psychologist. A doctor’s note stating that you are under duress because of emotional damages caused by your injury is the base of any emotional distress claim. It is very unlikely that an emotional distress claim will be accepted in court without a note from a medical professional on your emotional state.  If you do not have a physical injury and want to make a claim for emotional distress; you case may be harder to show that to a court of a law. In most of these types of cases, you would need to claim that the party that caused your emotional distress intentionally.
