If you get injured on the job, you should be compensated for your expenses. It is important to know what to do in the event of an accident; so you won’t have to go through it alone. If you are injured during your work, seek legal counsel to help you pursue your Workers’ Compensation claim.
Immediately After the Injury
As soon as you can after an injury while on the job, seek medical attention. Notify your supervisor of the event, including the location, time, and how it happened. Submit an accident report, in writing, to your employer. The doctor you visit will need to file a Doctor’s Initial Report within 48 hours of the accident – a copy of which will be sent to you, your employer, your insurance carrier, and your legal representatives.
Within a Month of the Incident
Within 10 days of notification, your employer will need to report the details of the incident to the Workers’ Compensation Board, as well as the company’s insurance agency. When the Form Employer’s Report of Work-Related Injury/Illness has been filed and returned, the insurer should be able to present a written document detailing your rights under the law. Payments should follow soon after, unless that document or the claim itself is being disputed.
You will need to file with the Workers’ Compensation Board on Form Employee Claim (C-3). This can be mailed in to your District Office. This can be done within two years of the incident, but it is important that you complete this sooner rather than later.
In the Months After
You should be receiving your Compensation of payment benefits every two weeks. If there is a halt or alter in payments; the Workers’ Compensation Board must be notified. Every 45 days at least, your doctor must submit a Progress Report on your recovery. After twelve weeks, your employer’s insurer may be allowed to reconsider the necessity of your treatment costs; and payments may be altered.
